OOHF paddling events are open to all individuals who acknowledge the ability to meet the following essential eligibility criteria.

1. Each participant must be 18 years older or accompanied by an adult.

2. Breathe independently (i.e., not require medical devices to sustain breathing)

3. Independently maintain sealed airway passages while under water.

4. Independently hold head upright without neck / head support.

5. Manage personal care independently or with assistance of a companion.

6. Manage personal mobility independently or with a reasonable amount of assistance.

7. Follow instructions and effectively communicate independently or with the assistance of a companion.

8. Independently turn from face-down to face-up and remain floating face up while wearing a properly fitted life jacket*

9. Get in/out or on/off of a paddlecraft independently or with a reasonable amount of assistance*

10. Independently get out and from under a capsized paddlecraft*

11. Reenter or remount the paddlecraft following deep water capsize independently or with a reasonable amount of assistance*

12. Maintain a safe body position while attempting skills, activities and rescues, and have the ability to recognize and identify to others when such efforts would be unsafe given your personal situation**

To participate in adaptive programs, participants must acknowledge only the first seven EEC listed above. Introductory adaptive training programs will involve teaching and practicing EEC #8-12.

Oceans of Hope Foundation INSURANCE WAIVER & RELEASE OF LIABILITY FORM

In consideration of being allowed to participate in any way in the Oceans of Hope Foundations programs, related events and activities, I and/or the minor participant, for myself, and on behalf of my heirs, assigns, personal representatives and next of kin, the undersigned:

1. Agree that prior to participating, I will inspect, or if a parent/legal guardian, I will instruct the minor participant to inspect the facilities and equipment to be used. If I believe, to the best of my ability, that anything is unsafe, I and/or the minor participant will immediately advise the Oceans of Hope Foundation of such condition(s) and refuse to participate.

2. Acknowledge and fully understand that I and/or the minor participant will be engaging in activities that involve risk of serious injury. including permanent disability and death. I understand that severe social and economic losses which might result only from my own actions, inactions, or negligence of others, rules of play or the condition of the premises or any equipment used. Further, that there may be other risks not known to me or not reasonably foreseeable at this time.

3. Assume all the foregoing risks and accept personal responsibility for the damages following such injury, permanent disability or death.

4. Release, waive, discharge and covenant not to sue the Oceans of Hope Foundation, its affiliated clubs, their representative administrators, directors, agents, coaches and other employees of the organization, other participants, sponsoring agencies, sponsors, advertisers, their heirs and if applicable, the owners and and leasers of the premises used to conduct the event, all of which are hereinafter referred to as "releases," from demands , losses or damages on account of injury, including death or damage to property, caused or alleged to be caused in whole or in part by the negligence of the releasee or otherwise.

I/WE HAVE READ THE ABOVE WAIVER AND RELEASE, UNDERSTAND THAT I/WE HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, HAVE NOT CHANGED IT ORALLY AND SIGN IT VOLUNTARILY.

Parent/Guardian with Legal Responsibility for this Participant

This is to certify that I, as a parent/guardian with legal responsibility for this participant, do consent and agree to his/her release as provided above of the Releasees and for myself, my heirs, assigns and next of kin, I release and agree to indemnify and hold harmless the Releasees from any and all liabilities incident to my minor child's involvement or participation in these programs as provided above, EVEN IF ARISING FROM THEIR NEGLIGENCE.

MEDIA RELEASE FORM

I herby authorize and give my full consent to the Oceans of Hope Foundation to copyright and/or publish any and all photographs, videos or film footage in which I appear while attending an Oceans of Hope Foundation event.

I further agree that the Oceans of Hope Foundation may transfer, use or cause to be used, these photographs, videos or film footage for any exhibitions, public displays, publications, commercials, artwork, advertising and television programs without limitations or reservations.

Battle Island Adventure Club L.L.C Agreement

I understand that my family's participation and/or involvement in the Battle Island Adventure Club, L.L.C. carries with it the potential for certain risk, some of which may not be reasonably foreseeable. I further acknowledge that these risk could cause me, or others around me, harm, including, but not limited to, bodily injury, damage to property, emotional distress, or death. I am a willing participant in the Battle Island Adventure Club L.L.C. and any programs sponsored by the club. By signing this agreement, I agree to release, indemnify, and hold harmless the Battle Island Adventure Club L.L.C, as well as all its employees, agents, representatives, successors, etc. from all losses, claims, theft, demands, liabilities, causes of action, or expenses, known or unknown arising out of my participation in, attendance at, etc. all programs and activities with the Battle Island Adventure Club, L.L.C

Oceans Of Hope Foundation COVID-19 Polity Adaptive Kayaking Program

Based on the best available information and guidance from the Re-Open Florida Task Force, the Florida Department of Health and the Centers for Disease Control, Oceans of Hope Foundation, Inc. (OOHF) has developed and adopts the following policies and event protocols for its adaptive kayaking program.

COVID-19 is a new contagion and there is limited information regarding risk factors for severe disease. Based on currently available information and clinical expertise, older adults and people of any age who have serious underlying medical conditions are vulnerable populations that may be at higher risk for severe illness from COVID-19. Based on what is known now, those vulnerable populations at high-risk for severe illness from COVID-19 are:

• People 65 years and older
• People who live in a nursing home or long-term care facility
• People of all ages with underlying medical conditions that include:
o People with chronic lung disease or asthma
o People who have heart disease
o People who are immunocompromised. Conditions causing a person to be immunocompromised include cancer treatment, smoking, bone marrow or organ transplantation, immune deficiencies, HIV or AIDS, and prolonged use of corticosteroids and other immunosuppressant medications for autoimmune diseases
o People with severe obesity (body mass index [BMI] of 40 or higher)
o People with diabetes
o People with chronic kidney disease undergoing dialysis
o People with liver disease
o People who have limited mobility or who cannot avoid coming into close contact with others who may be infected, such as direct support providers and family members
o People with a spinal cord injury that affects their respiratory system
o People who have trouble understanding information or practicing preventive measures, such as hand washing and social distancing
o People who may not be able to communicate symptoms of illness

OOHF has adopted guidelines to mitigate the risks of infection and illness for ALL guests, caregivers and volunteers participating in Foundation adaptive kayaking events. The protocols identified in the Guest/Caregiver and Volunteer Notices and incorporated into this policy statement establish the guidelines and event execution standards to be followed during Foundation events. The “NOTICES” that are part of this policy shall be provided to all guests, caregivers and volunteers prior to their participation in OOHF adaptive kayaking events. Additionally, each guest (or parent/guardian for minors), caregiver and volunteer is to execute the “WAIVER/RELEASE FOR COMMUNICABLE DISEASES INCLUDING COVID-19” included in this policy statement prior to their event participation. The following general guidance is compulsory for Foundation guests, caregivers and volunteers:

• If you believe you are infected with COVID-19, contact your health care provider immediately. Do not participate in OOHF events.
• If you are older than 65 years of age or have a serious underlying medical condition, avoid large crowds. You must notify the OOHF that you are a member of the identified vulnerable populations PRIOR TO participating in any OOHF adaptive sport event.
• Do not participate in OOHF programs if you have a cough, fever, upset stomach, and/or have been in contact with someone who has COVID-19 symptoms or had tested positive for COVID-19 within the 14 days prior to the OOHF event.
• Practice social distancing, maintain 6 feet of separation from other guest paddlers and volunteers.
• Do not hug, handshake, or be in close quarter situations with other event participants.
• Frequently wash hands with soap and water for at least 20 seconds or use hand sanitizer with at least a 60 percent alcohol base if soap and water are not available.
• Don’t touch surfaces where ever possible.
• Wear a face mask or cloth face cover when participating in OOHF adaptive kayaking events. It may be permissible to remove masks once on the water with 6-foot separation as exertion while wearing a mask may lead to respiratory issues.
• Avoid touching eyes, nose and mouth.
• Cover your cough or sneeze with your elbow or a tissue and dispose of the tissue. The following NOTICES for guests, caregivers and volunteers establish conduct guidelines for all participating individuals and protocols for executing adaptive kayaking events. The documents include:

ASSUMPTION OF RISK / WAIVER OF LIABILITY / INDEMNIFICATION AGREEMENT

In consideration of participating in Oceans of Hope Foundation, Inc. adaptive sports programs and related events and activities, the undersigned acknowledges, appreciates, and agrees that:
1. The Participant has not been exposed to COVID-19, has not tested positive for COVID-19 and has not experienced any symptoms of COVID-19 in the 14 days prior to the OOHF event.
2. Participation includes possible exposure to and illness from infectious diseases including but not limited to MRSA, influenza, and COVID-19. While particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist; and,
3. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and,
4. I willingly agree to comply with the stated and customary terms and conditions for participation in regards to protection against infectious diseases. If, however, I observe and any unusual or significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately; and,
5. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS Oceans of Hope Foundation, Inc and Battle Island Adventure Club, LLC their officers, officials, agents, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event (“RELEASEES”), WITH RESPECT TO ANY AND ALL ILLNESS, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF RELEASEES OR OTHERWISE, to the fullest extent permitted by law.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

FOR PARTICIPANTS OF MINOR AGE (UNDER AGE 18 AT THE TIME OF REGISTRATION)

This is to certify that I, as parent/guardian, with legal responsibility for this participant, have read and explained the provisions in this waiver/release to my child/ward including the risks of presence and participation and his/her personal responsibilities for adhering to the rules and regulations for protection against communicable diseases. Furthermore, my child/ward understands and accepts these risks and responsibilities. I for myself, my spouse, and child/ward do consent and agree to his/her release provided above for all the Releasees and myself, my spouse, and child/ward do release and agree to indemnify and hold harmless the Releasees for any and all liabilities incident to my minor child’s/ward’s presence or participation in these activities as provided above, EVEN IF ARISING FROM THEIR NEGLIGENCE, to the fullest extent provided by law.
